GOOD CONTRIBUTORS FOR TEMPORARY ADMISSION

GENERAL REGULATIONS

  1. The user of the Temporary Admission System who qualifies as a Good Contributor, in category A, B, or C, can guarantee the tariff duties that correspond to Temporary Admission operations via a Letter of Commitment or Promissory Note according to Annexes 1 and 2, with the value guaranteed depending on the category granted.   

  2. The control of suspended percentages of customs duties and other import taxes, which can be guaranteed by a Letter of Commitmentor Promissory Note, as well as the custody and clearance, are the responsibility of the Customs Intendencies nationwide. 

  3. The Good Contributor of category B) or C), can request a requalification to a more beneficial level, providing the requirements for that level are met, by presenting a new request. The procedure for re-qualification similar to that of qualification. 

  4. Customs is to issue a decision within a term of ten (10) working days from the date the request is presented. At the end of the term, the petition for qualification or re-qualification is automatically approved. 

  5. The archive of documentation and its decisions on Qualification or Requalification as a Good Contributor are filed with the National Customs Collection Intendency, as are those of Exclusion antecedents, once the procedures have been concluded. 

  6. For the documentation procedure of Temporary Admission clearance of Good Contributors, Customs Intendency personnel must check on the situation of each beneficiary in the option of Good Contributors in the Temporary Admission Module. 

ENTRY OF REQUEST:

  1. The user of the Temporary Admission System presents his request for qualification or requalification of Good Contributor in Temporary Admission to the Documentary Process Area of the CUSTOMS Headquarters, where the file is registered to immediately send it on to the Collection Control Division of the National Customs Collection Intendency. 

Evaluation

  1. The Head of the Collection Control Division channels the file to the personnel responsible for evaluation (Evaluator) who initial verifies that the administrative requirements have been met. 

  2. If the file is not complete, the Evaluator issues a Notification, which is signed by the Head of the Collection Control Division, so that the user can within a term of ten (10) week days correct the observations. 

  3. The term for qualification is suspended from the date the Collection Control Divsion notifies the user to correct the observations on the request until the requirements are again presented within the established term of ten days. If the requirements are not met as requested, the Head of the Division declares the documentary procedure as abandoned via an Administrative Notification and orders the closing of the file. 

  4. If the file is approved or once the observations are corrected, the Evaluator enters the following data into the Good Contributors Module: 
    1. File number
    2. Date presented
    3. RUC (tax registration) number, if a company/institution
    4. Number of Electoral Registration Card or National Identity Card (DNI), if an individual 
    5. Name
    6. Category requested
  1. The evaluator, using the Good Contributors Module, initiates the evaluation process, which consists of verifying if the user complies with the following requirements:  
    1. Has complied with regularizing Temporary Admission operations within the established periods for qualification. 
    2. Has not incurred in any infraction that is subject to fines within the Temporary Admission System. Not included for consideration in this clause are fines or sanctions with an accumulated value of less than or equal to one (1) Tax Unit (2001 Tax Unit= S/.3000), nor resolutions that are partially pending. 

Resolutions partially pending are considered to be those that are paid and not reclaimed, fines that are not paid nor reclaimed, and fines ratified by Resolution by the Fiscal Court. 

    1. That requested Temporary Admssion operations have not been annuled by the pertinent section. 

The user must register a minimum number of Temporary Admissionoperations with completion and/or regularization according to the category requested. 

The current procedure for qualification of good contributors is stipulated in the regulations of INRA-PE.07 Good Contributors - approved via National Intendency Resolution Nš 233 of 18.SEP.1999.
